.) THE CASE OF JAMES
James is 16 years old and his parents take him to see a counselor. They know that he has experimented with drugs in the past but he has assured them that he is no longer using drugs. At their first meeting the counselor meets with all three of them. She explains that confidentiality will be important if she agrees to continue meetings with
James alone. The parents understand that this is necessary for the counselor to build trust with James and they understand that the counselor will not talk with them about information from sessions with James. At some point, James tells the counselor that he is using illegal drugs. He goes to school under the influence of drugs daily and he often drives while under the influence and takes other risks with his life. She tells him he must stop if she is to continue to be his
counselor and that if he stops she won’t tell his parents. He stops for a while, but one night, he decides to use drugs again, gets into a bad accident and becomes paralyzed. His parents learn that the counselor knew of the drug use and they sue her and the agency saying that they had a right to know about their son’s drug use.
